Company Formation Strategies

This section outlines several asset protection strategies, along with their costs and benefits. It also covers the essentials of international planning, including companies, banking, and trusts, how they are structured, and why. For each company you form through our service, we can also help you open a corporate bank account.
Many jurisdictions have legal systems designed to support asset protection and financial privacy. Consider the legal environment in the US, where litigation is common and costly. In many other countries, the losing party in a lawsuit is typically required to pay the winner's legal fees, which can discourage lawsuits. The US generally does not follow this rule.
This content is for general information only and is not legal, tax, or financial advice. Laws vary by jurisdiction and individual circumstances, and clients remain responsible for all applicable tax and reporting obligations in their home country.

A Layered Defense for Your Assets

In the US, even winning a lawsuit can leave you out of pocket for your own legal costs. Some international jurisdictions make it harder to bring claims against a company. In certain cases, a claimant must post a bond or meet procedural requirements before a case can move forward, which can discourage weak or speculative lawsuits. These legal features add a meaningful layer of protection and may reduce the likelihood of being sued.
The Nevis LLC is a good example. A 2015 amendment requires a creditor to post a $100,000 bond before bringing an action to collect a judgment against a member of the company. Later amendments gave Nevis courts discretion to set the bond at a higher amount. Along with greater financial privacy, features like these are among the reasons clients choose to structure internationally. The Cook Islands is another well-regarded jurisdiction for LLCs. You can read our comparison of the Nevis LLC and the Cook Islands LLC for more detail.

TYPES OF COMPANIES

International entities, including corporations, LLCs, and International Business Companies (IBCs), can offer more privacy than many domestic entity types. Many jurisdictions have competitive laws for international clients, including:
  • Privacy of ownership
  • Privacy for officers and directors
  • Limited recognition of foreign judgments

Incorporation
